Terms of Use

1. Acceptance of Terms

By downloading or using FestivPetAI ("the App"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the App. We may update these terms from time to time; continued use of the App after changes are posted constitutes acceptance of the revised terms.

2. Description of the Service

FestivPetAI lets you dress your pet for festivals using AI. Core features include:

• Selecting festival themes (e.g. Christmas, New Year) with headwear, facewear, neckwear, bodywear, and props;
• Choosing a festive background scene for your creation;
• Uploading a pet photo from your camera or photo library;
• Generating a festive AI image using cloud-based AI models;
• Adding custom text caption overlays — including drag-to-reposition, resize, and colour customisation;
• Auto-saving creations locally to My Creations;
• Re-editing and re-burning captions on any saved creation from My Creations;
• Sharing creations to the Community feed or via your device's share sheet;
• Browsing and "loving" creations shared by other users in the Community feed.

3. Account & Authentication

You may browse the App anonymously without creating an account. To generate AI images and share creations to the Community feed, you must sign in. We support:

• Google Sign-In;
• Apple Sign-In (iOS);
• Passwordless email (magic link).

You are responsible for keeping your sign-in credentials secure. You may sign out at any time; the App will restore an anonymous browsing session automatically. You may permanently delete your account from the Settings page, which will remove your user profile and soft-delete your community creations.

4. Your Pet Photos & Uploaded Content

You retain full ownership of the photos you upload. By uploading a photo you grant FestivPetAI a limited, non-exclusive licence to:

• Transmit and process the photo via third-party AI services solely to generate your festive image;
• Store the photo in secure cloud storage (Firebase Storage) if and only if you choose to share the creation to the Community feed. In that case, the original photo is stored at a non-public URL and displayed as an inset alongside your AI-generated image within the App.

If you do not share to the Community feed, your original photo is never stored on our servers after generation is complete. Generated images are auto-saved in-app to My Creations (local device storage) with the caption burned in.

5. AI-Generated Images

Images are produced by third-party AI models. Results may vary in quality, style, or accuracy. You acknowledge that:

• AI-generated images are not guaranteed to meet any particular standard;
• The same inputs may produce different outputs on different occasions;
• You own the creative output of your generations, subject to the terms of the underlying AI provider's usage policies.

You agree not to use the generation feature to produce content that is unlawful, defamatory, sexually explicit, hateful, or that infringes the rights of any third party.

6. Community Creations & User Content

When you share a creation to the Community feed:

• Your AI-generated image is uploaded to Firebase Storage and publicly displayed in the Community feed.
• Your original pet photo is also uploaded to Firebase Storage and displayed as an inset thumbnail alongside the AI-generated image.
• Associated metadata (festival name, accessories, background, caption text, pet name, and your user ID) is stored in Firestore and may be visible within the App.

By sharing you grant FestivPetAI a worldwide, royalty-free licence to display and distribute that creation within the App and in promotional materials for the App. You must only share photos of pets you own or have explicit permission to feature publicly. You may delete a shared creation at any time — this will remove both the AI-generated image and the original photo inset from the Community feed.

7. Caption Overlays

You can add, reposition, resize, and recolour text captions on your generated image. Captions are burned into the final saved image. You are solely responsible for any caption text you create. You agree not to include text that is offensive, defamatory, misleading, or infringes any third-party rights.

8. Prohibited Conduct

You agree not to:

• Upload images that contain people without their consent;
• Attempt to reverse-engineer, scrape, or exploit the App or its AI generation endpoints;
• Use the App in any way that could damage, overload, or impair our servers or third-party services;
• Circumvent any authentication or access controls;
• Use the App for any commercial purpose without our prior written consent.

9. Third-Party Services

The App integrates with the following third-party services, each governed by their own terms and privacy policies:

• Firebase (Google LLC) — authentication, database, and cloud storage;
• AI image generation providers (FLUX, Google Flash Image);
• Google Sign-In and Apple Sign-In.

We are not responsible for the practices or content of these third-party services.

10. Local Data & My Creations

Every creation is auto-saved in-app to My Creations using local SQLite records and local app files, with the caption burned directly into the saved image. You can re-edit and re-burn the caption on any saved creation at any time from My Creations. You may delete individual creations or all local data at any time from the My Creations page. Uninstalling the App will remove all locally stored data.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that generated images will meet your expectations.

12. Limitation of Liability

To the fullest extent permitted by applicable law, FestivPetAI and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including loss of data, loss of generated content, or any AI output that does not meet your expectations.
